Testable Subject Areas on the Texas Bar Examination
The Texas Bar Examination consists of four sections: The Multistate Bar Examination (MBE), The Procedure and Evidence Exam, the Texas essay exam, and the Multistate Performance Test (MPT).
The Procedure and Evidence Exam consists of 40 short-answer questions covering both civil and criminal procedure and evidence to be completed in 90 minutes. The P&E is a hand-written exam with each question being limited to a five- line answer.
The Texas Essay Exam consists of 12 essay questions to be completed two 3 hour sessions with each session covering 6 questions. The essay questions are not identified by subject matter. The Texas Essay Exam may be handwritten or typewritten via laptop. - Business Associations, including Agency, Corporations, Partnerships, Limited Liability Companies and Professional Associations (2 essays)
- Trusts and Guardianships (1 essay)
- Wills and Administration (2 essays)
- Family Law (2 essays)
- Uniform Commercial Code (2 essays)
- Consumer Rights, including DTPA and Insurance (1 essay)
- Real Property, including Oil and Gas (2 essays)
Procedure and Evidence Subjects
- Income, Estate, and Gift Taxation (usually found in questions regarding family law, oil and gas, wills, etc.)
- Bankruptcy (included where appropriate, as an element of questions in other subjects such as family law, wills and estates, real property, etc.
MBE Subjects in relation to Texas Essays
- Texas Civil Procedure and Evidence including Jurisdiction
- Federal and Texas Criminal Procedure and Evidence
- While subjects covered by the MBE are not emphasized in the Texas Essays, essay subjects may involve some issues covered on the MBE. For example, the UCC essay questions may involve the chapter on sales that may be applicable in some questions concerning contracts on the MBE, and the family law (and real property) essay questions frequently involve issues concerning real property, also covered on the MBE. You will be expected to recognize and discuss all issues raised by the facts, regardless of possible overlap among subjects.
